COPYRIGHT TRANSFER CONDITIONS The images, text, and graphics presented on this site are not free of rights. No content of this website can be published or distributed to third parties without prior consent from Adventure4ever.com The following conditions apply to all users of this website and formally bind the signatories of the present transfer agreement. Each signatory declares having the necessary representation powers. Each photo or reportage and or text is subject to protection under intellectual property legislation. Without prior consent from Adventure4ever.com, the transfer of copyright is valid for one publication, in one language and one user whatever the medium. Any re-publication, transfer to another medium or user or data base or third party is prohibited without prior consent from Adventure4ever.com. If Adventure4ever.com loans an original slide to the publisher, the publisher will be subject to a fee for any loss or damage. The amount of this fee will be fixed according the value of the given picture with a minimum of 1000 Euro per original slide. All reproduction and/or representation will bear the obligatory mention of the photographer’s name and that of Adventure4ever.com. In case of an omission, Adventure4ever.com tariff will be automatically doubled. The publisher cannot oppose this double billing. No photograph/image can be altered in any way by any means without prior consent from Adventure4ever.com or its representative. Cropping for layout purposes is the sole alteration possible without prior consent. The publisher bears sole responsibility for any changes made to the captions of photographs and reportage text by Adventure4ever.com. Adventure4ever.com guarantees the origin and authenticity of the document supplied. The transfer of reproduction and/or representation rights for one or several photographs by Adventure4ever.com does not exempt the publisher from taking necessary measures to respect the rights of persons photographed. If need be, the publisher will obtain authorizations for publication from persons photographed, or from the owners of photographed objects or works, or written permission from Adventure4ever.com. The publisher bears sole responsibility for any publication without written permission from the person(s) photographed, or the owners of object or works photographed, or Adventure4ever.com. In case of a litigation, the publisher waives the right to rely on Adventure4ever.com as guarantor. The publisher agrees to send all proof of publication to Adventure4ever.com, which will be used by Adventure4ever.com to control reproduction/representation rights and the pre-agreed tariffs. The present contract will be interpreted under Dutch law relative to contracts signed and executed in The Netherlands. In case of a disagreement concerning the present contract or failure of the parties to meet its requirements, the parties involved will entrust jurisdiction to the competent Amsterdam Courts. DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY The publisher expressly agrees that use of Adventure4ever.com is at his sole risk. Neither Adventure4ever.com nor any of their respective employees, warrant that Adventure4ever.com will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of Adventure4ever.com, or as to the accuracy, reliability or content of any information, or service provided through Adventure4ever.com Adventure4ever.com is provided on an “as is” basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. In no event will Adventure4ever.com, or any person or entity involved, in creating, producing or distributing content of Adventure4ever.com, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use Adventure4ever.com. You hereby acknowledge that the provisions of this section shall apply to all content on Adventure4ever.com.
